Recognitions

Both the Soil Quality Decree and the Decree on reporting industrial waste and hazardous waste impose requirements on both the quality and the integrity of the implementing organizations. Companies and government agencies, the so-called soil intermediaries, that want to carry out designated activities must be in possession of a certificate and recognition. Clients may only engage recognized soil intermediaries.

Producers of building materials or soil can use various environmental hygiene declarations to demonstrate that their product meets the requirements of the Soil Quality Decree, namely the recognized quality declaration, the batch inspection carried out by a recognized intermediary or the Manufacturer's own declaration.

Apply for or change recognition

The procedure for applying for or changing accreditation from Rijkswaterstaat has a number of components. These parts are explained below:

Search for recognized companies

Validity period of accreditation, certificate or recognition

Recognition is issued for an indefinite period. An accreditation or certificate is issued for a period of 3 years. The Ministry of Infrastructure and Water Management has agreed with various certifying institutions that if a certificate has been extended after these 3 years, this will be reported by the certifying institution to Rijkswaterstaat without the intervention of the organization. The soil intermediary does not have to pass on these changes to Rijkswaterstaat. It implements this change ex officio.

Withdrawal or suspension of an recognition

Rijkswaterstaat can withdraw or suspend the accreditation of a company. A soil intermediary whose recognition has been withdrawn is no longer allowed to carry out the activities for which they were recognized.

Suspension or withdrawal by the Human Environment and Transport Inspectorate

In addition to administrative grounds, the Human Environment and Transport Inspectorate (ILT) can also suspend or withdraw recognition if there is a case of forgery. This is also possible if a statutory provision is violated by or pursuant to this decision or Article 225 of the Criminal Code, insofar as the violation is related to an activity.
