Application for recognition

Both the Soil Quality Decree and the Decree on reporting industrial waste and hazardous waste impose requirements on both the quality and the integrity of the implementing organizations. The designated work may only be carried out by recognized soil intermediaries. We process applications for recognition and publish lists of recognized intermediaries. Clients may only use recognized soil intermediaries. Competent authorities can test this.

Conditions

When we receive the application, we check whether the application is complete, namely whether:

  • The application form has been completed correctly and completely
  • In case you have not logged in via eIDAS, or a valid power of attorney has been attached
  • The certificate or accreditation for the activity in question is correct
  • The extract from the Chamber of Commerce is up to date
  • In the case of a personal registration, a (valid) Certificate of Good Conduct is attached

If the application is incomplete or unclear, you can supplement the application. The statutory processing period will then be suspended. You will be given a period of four weeks to supplement or clarify the application.

Does the application remain incomplete or unclear? The application will then not be processed on the basis of the General Administrative Law Act. You must then submit a new application to Rijkswaterstaat.

Procedure

After the acceptance test, we assess the application on the following points:

  1. request advice from, among others, the Human Environment and Transport Inspectorate (ILT).
  2. administrative and/or criminal history of the directors, the company and the employees.
  3. of the company or institution is in a state of bankruptcy or suspension of payments.
  4. A Bibob examination can also be carried out.

Costs

An application for recognition is free of charge.

Period

The procedure for applying for and changing recognition is laid down in Articles 11 and 12 of the Soil Quality Decree.

The legal period for processing a new recognition is 8 weeks. The term for a change request is 4 weeks. Rijkswaterstaat may extend this procedural period for a reasonable period. The provisions of the General Administrative Law Act apply to the procedure for applying for and amending recognition.

Objection and appeal

Rijkswaterstaat issues a decision. In most cases the application is granted. If this is not the case, Rijkswaterstaat will inform the applicant about this. Rijkswaterstaat asks the applicant to submit an opinion. After receiving the views, Rijkswaterstaat will make a decision. Objection and appeal against this decision are possible in accordance with the General Administrative Law Act.

On the envelope and on the notice of objection itself, state 'Bezwaarschrift LOBO'. You send your notice of objection to:
